Welcome to Spurr! These Terms and Conditions ("Terms") govern your use of the Spurr mobile application (the "App"), which provides users with the ability to find and join activities happening around them. The terms “us” or “we” refer to the individual creator and operator of the App, whose sole purpose is to provide a platform for recreational use. By creating an account and using our services, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using Spurr, you confirm that you are at least 16 years old and are legally capable of entering into this agreement. If you are using the App on behalf of an organisation, you agree to these Terms on its behalf.

2. Services Provided

Spurr allows users to discover and join various activities. We do not organise, host, or manage these activities, nor do we verify the accuracy or safety of any activities listed on our platform.

3. User Accounts

To use Spurr, you must create a user profile. You agree to provide accurate and complete information. You are responsible for maintaining the security of your account and any activities conducted under your profile.

4. User Conduct

By using Spurr, you agree that you will not:

• Misrepresent yourself or provide false information.

• Engage in any illegal, harmful, or fraudulent activities.

• Harass, threaten, or discriminate against other users.

• Disrupt the functionality of the App or attempt to gain unauthorised access.

5. Content and Intellectual Property

Users may submit content (such as activity descriptions, reviews, and messages). By posting content, you grant Spurr a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content for the purposes of operating and promoting the App. You must have the rights to any content you submit and ensure that it does not infringe on third-party rights. Spurr retains all intellectual property rights related to the App and its branding.

6. Third-Party Activities and Liability

Spurr is not responsible for the organisation, safety, or outcomes of activities listed on the App. We do not conduct background checks or vet activity hosts. Participation in any activity is at your own risk, and Spurr disclaims any liability for injury, loss, or damages resulting from participation in activities found via the App.

7. Availability and Modifications

Spurr is provided "as is" and "as available." We may update or modify the App at any time without prior notice. We reserve the right to suspend or terminate your access if you violate these Terms.

8. Privacy Policy

Our use of your personal data is governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Termination

You may delete your account at any time. We reserve the right to terminate or suspend your access if you breach these Terms. Upon termination, any rights granted under these Terms will immediately cease.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Spurr makes no guarantees about the accuracy, availability, or reliability of the App. As this App is provided free of charge and on a voluntary, "for fun" basis, we are not liable for any damages, including but not limited to personal injury, lost profits, or data loss, arising from your use of the App, except in cases of our gross negligence or wilful misconduct.

11. Governing Law

These Terms are governed by the laws of the Netherlands. However, nothing in this clause affects the statutory rights of consumers residing in the United Kingdom or elsewhere to bring a claim in their country of residence. Any disputes arising from these Terms will be resolved in the courts of the Netherlands.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within the App. Your continued use of the App after the effective date of the new Terms constitutes your acceptance.
